The Prosecution applies for leave to appeal Oscar Pistorius conviction and sentence.

In South Africa, the State has applied for leave to appeal against Oscar Pistorius' conviction and sentence. The implication is that there may be a re-trial and a possible harsher sentencing.

Oscar Pistorius was found guilty of culpable homicide in the killing of his girlfriend Reeva Steenkamp and given a five years jail term.

It is understood that the prosecution team were unhappy with both the conviction and sentence as they wanted him convicted for premeditated murder and given a higher prison sentence. As a result, they have filed for leave to appeal the judgement.

"Today, we announce that the the National Prosecuting Authority (NPA) has filed the application for leave to appeal both the conviction and sentence. The appeal on conviction is based on the question of law," said NPA spokesperson Nathi Mncube in a statement.

"The merits of the NPA's argument in this regard are contained in the papers that were filed with the registrar of the North Gauteng High Court today.

"This means that the matter is now officially sub judice and consequently the NPA will not be able to discuss the matter publicly until judgment is delivered by the court."
